Supreme Court dismisses injunction application against implementation of E-Levy by GRA

The Supreme Court has dismissed an application for an injunction against the Ghana Revenue Authority GRA to stop the implementation of the controversial Electronic Transaction Levy (E-Levy).

One could recall when three members of Parliament, Minority Leader-Haruna Iddrisu, Bawku Central MP-Mahama Ayariga and North Tongu MP-Samuel Okudzeto Ablakwa filed a suit against the passage of the E-Levy saying the Supreme Court should investigate the passage very well because they used illegal means of passing it describing it as unconstitutional.

The three MPs has however filed another suit after the E-Levy has taken effect on May 1, 2022. According to them, Supreme Court should place an injunction on GRA in order to stop them from implementing the E-Levy until the final determination of their previous suit challenging the constitutionality of the passage of the E-Levy.

But the court after its sitting today dismissed the application saying, before the passage of the E-Levy would be heard and ruled as unconstitutional, then the GRA should keep an accurate record of proceeds since its implementation for reimbursement.

Meanwhile, lawyer for the MPs, Godwin Kudzo Tameklo, on April 19, 2022, said that a lot of people would suffer harm if the E-Levy is not put at a halt and the court determines its passage as unconstitutional.
